提出意見： 経口中絶薬「メフィーゴパック」つまり、胎児毒殺の医薬品製造販売承認に反対 します。
理由：1. 私たちすべての人間は、受精ー着床ー母体内での生育ー出産を経てこ の世で生きています。刑法の殺人は出産後に適用されますが、本来ならば出生前
の胎児にも適用されるべきです。つまり、妊娠何週目であろうと、胎児の命を故 意に中断することは出生後に殺害するのと差異はありません。妊娠中絶を希望す
る人の理由は、(1) 合意の上、あるいは遊び半分などの無知、あるいは強姦によ り予期しない妊娠をしてしまった。 (2) 出生前診断で胎児に異常のある可能性
が見つかった。(3) 妊婦と胎児双方の命の継続が困難と言われ、胎児を犠牲にす るなどの理由があるかと思います。今回は(3)の議論は省きたいと思います。
２. (1)と(2)の理由で胎児の毒殺または手術による中絶は認めるけれども、出生 後の人間にはいかなる理由であろうと殺害は犯罪だということは法令がそう定め
ているだけであってスジが通りません。障害があるから、痴ほう症だから、ある いは積極的安楽死に手を貸せば殺人になるのに、胎児ならなぜ許されるのでしょ
うか。胎児も生きる（母体内で生かしてもらう）権利があるはずです。周知のと おり、民法では「胎児は損害賠償の請求権」と「相続」は既に生まれたものとみ
なす、と規定しています。（民法第七百二十一条、同第八百八十六条)
３．この胎児毒殺薬は手術的中絶よりは妊婦に負担が少ないとのことですが、胎 児を殺害するために処方するのであれば、胎児の命を奪うことに変わりありませ ん。
４．先に行われたパブリックコメントの緊急避妊薬のスイッチ化でもいえること ですが、この胎児毒殺薬が使われるようになれば、婚前・婚外の性交渉を助長す
ることも危惧されます。つまり、望まない妊娠をしてしまったら、この中絶薬を 飲めばよいという安易な気持ちにさせると思います。妊娠は男性の関りがあって
成立するのに、中絶の負担は女性に負わせることは不公平ですし、心的にも深い 傷を生涯感じさせることになりかねません。つまり、手術的であれ、服毒であ
れ、中絶は女性の尊厳を非常に傷つけることになるでしょう。従って、女性は望 まない妊娠や、妊娠したら困る情況での性交渉に慎重でなければならないと同時
に、男性側もその責任を担う覚悟が必要です。そのような教育を早くから行うべ きであります。
5. それにもかかわらず、望まない妊娠をしたり、出生前診断で胎児の異常の可能 性が見つかっても、中絶つまり胎児の命を奪う方法ではない方策を提供できるよ
うにすべきだと思います。胎児を含め、すべての人は生きる権利をもっていると いう前提に立った方策、たとえば熊本の慈恵病院の「赤ちゃんポスト」や実子特
別養子制度の推進や充実のために行政も含めた支援体制が図られるべきです。
以上の理由により、この胎児毒殺薬は胎児の生きる権利を奪うものであり、製造 販売・処方・服用に供されることに反対いたします。

以上に関する雑感
1.. 私たちすべての人間は、受精ー着床ー母体内での生育ー出産を経てこの世で生きている。この過程で故意に生育を中断することは、出生後に殺害するのと、どこに差異があるのだろうか？
２. 経口中絶薬が優生保護法指定医を通してであっても、簡単に処方・服用が可能になれば、夫婦間、婚前・婚外の性交渉が安易に行なわれることが危惧される。つまり、望まない妊娠をしてしまったら、この中絶薬に頼ればよいということにならないか？
３. LGBTやジェンダー問題が活発に論じられているが、こと妊娠と出産に関しては今後とも女性が分担しなければならないであろう。女性が望まない妊娠をしてしまって、その命を手術的であれ薬物的であれの方法で絶つことになれば、相手の男性以上に女性のほうが重い負担を負わされて不公平であるし、心的にも深い傷を感じるのではないだろうか。そうであれば、中絶は女性の尊厳に反するのではないか？ したがって女性は望まない妊娠や、妊娠したら困る情況での性交渉に慎重でなければならないし、男性側もその責任を担う覚悟が必要である。といってもどのように？
４. それにもかかわらず、望まない妊娠をしてしまったら、どう対処すべきか？ その命はただ生きる権利をもっているという前提に立てば、出産した命を自分で育てるか、他の方に育ててもらうかを選択することになる。後者の選択が可能なためには行政も含めた支援体制が必要である。たとえば、
熊本の慈恵病院の「赤ちゃんポスト」のように。
